Introduction

Tether Health, LLC (collectively, “Tether Health”, “we”, “us”, “our”) is in the business of connecting patients, physical therapy providers and orthopedic providers through Tether Health's application to allow providers to monitor patient progress and recovery. Tether Health works with independent professionals such as physical therapists and orthopedic surgeons (collectively, “Professionals”) to ensure appropriate referrals are made, ensure follow-up on referrals and monitor ongoing patient progress, all via the Tether Health Website and Platform.

Tether Health is the creator of the Tether Health application, Website and associated content, functionality and services (the “Platform”). The Platform, including all relevant content and functionality associated with the Platform, and Tether Health's Website (the “Website”), are collectively referred to as the “Services”.

We are committed to protecting your Personal Information and making sure you understand your rights related to our use and disclosure of such information while providing Services to you.

This Privacy Policy describes:

  • Personal Information that we receive from you when you interact with the Services, including search queries on the Platform
  • How we use and process the Personal Information that we receive
  • If and why Personal Information may be disclosed to third parties
  • Your choices regarding the collection and processing of your Personal Information

When you access the Services or send your Personal Information to us via email, text messages, or other electronic messages, you consent to receive communications from us, in accordance with this Privacy Policy.

Important: Please read this Privacy Policy carefully. If you don't agree with this Privacy Policy, do not use our Services. By accessing or using our Services, you agree that you have read this Privacy Policy and you understand, and consent to be bound by, the terms and conditions herein.

Healthcare Information

Tether Health is not itself a healthcare provider. Therefore, Tether Health may not have to comply with the Health Insurance Portability and Accountability Act of 1996, Public Law 104-191, and its related regulations and amendments from time to time (collectively, “HIPAA”) and other state laws regarding specific protections for medical records information (“Privacy Laws”). However, depending on how you access or use the Platform, Tether Health may receive, maintain, use, and disclose certain health-related information on behalf of a healthcare provider, health plan, or other entity that is subject to HIPAA (a “Covered Entity”). In those circumstances, Tether Health may act as a business associate of the HIPAA Covered Entity and will process such information in accordance with HIPAA, applicable law, and the applicable business associate agreement (“BAA”) with that Covered Entity.

If you receive healthcare services from a Covered Entity, the Covered Entity's Notice of Privacy Practices (“NPP”) describes how the Covered Entity may use and disclose your protected health information and your rights under HIPAA. This Privacy Policy does not replace a Covered Entity's NPP. A Covered Entity is responsible for providing individuals with a NPP as required by law.

Changes To This Privacy Policy & Notifications

We reserve the right to amend this Privacy Policy at any time. We will notify you and/or require you to accept the updated Privacy Policy only if the supplemented, amended or otherwise modified Privacy Policy implements material changes from Tether Health's then-current Privacy Policy. It is your responsibility to carefully review this Privacy Policy each time you visit, access or use the Service.

Tether Health may provide you with notices, including those regarding changes to this Privacy Policy, using any reasonable means now known or hereafter developed, including by email, regular mail, SMS, MMS, text message, or postings on the Website or Platform.

We will not make retroactive changes that reduce your privacy rights unless we are legally required to do so. Your continued use of our Services after we make changes shall constitute your acceptance of those changes, so please check this Privacy Policy periodically for updates. The amended Privacy Policy supersedes all previous versions.

Information We Collect About You

The Personal Information we collect depends on how you interact with us, the portions of the Service you use, and the choices you make. We receive and collect information that you directly submit to us or that we gather when you use our Services or interact with our advertising and applications on third-party websites and services.

Personal Information

Your name, mailing address, telephone number, email address, demographic information (e.g., age, gender, ethnicity), payment information, communications via text and email, and other identifiers you provide to us.

Non-Personal Information

IP addresses, device information, usage data, information passively or automatically collected through cookies, your browser or device, and information from third parties.

Inferences

Information inferred from other data we collect, including using automated means to generate information about your likely preferences or other characteristics, such as your general geographic location based on your IP address.

Healthcare Information

Personal information related to your health that we collect or infer in connection with providing, administering, improving, securing, and evaluating your eligibility for Services, including fraud prevention, analytics, and compliance.

Cookies & Other Data Collection Tools

Cookies are small text files placed by a website and stored by your browser on your device. A cookie can later be read when your browser connects to a web server in the same domain that placed the cookie.

Web beacons are electronic images (also called single-pixel or clear GIFs) that are contained within a website or email. When your browser opens a webpage or email that contains a web beacon, it automatically connects to the web server that hosts the image.

Mobile advertising IDs are generated by operating systems for mobile devices (iOS and Android) and can be accessed and used by apps in much the same way that websites access and use cookies.

Your Cookie Controls

Cookie Controls: Most web browsers are set to accept cookies by default. You can go to your browser settings to learn how to delete or reject cookies. Visit www.allaboutcookies.org for more information.
Global Privacy Control (GPC): Some browsers and browser extensions support GPC signals. When we detect such a signal, we will make reasonable efforts to respect your choices as specified by applicable law.
Do Not Track (DNT): Our Website does not respond to browser DNT signals as there is no common industry standard. Instead, you can use the GPC, cookie controls, and advertising controls described above.
Mobile Advertising ID Controls: iOS and Android operating systems provide options to limit tracking and/or reset the advertising IDs.
Email Web Beacons: Most email clients have settings that allow you to prevent the automatic downloading of images, which prevents connection to the web servers that host those images.

How We Use Your Personal Information

Tether Health processes your Personal Information for legitimate business purposes, the fulfillment of our services to you, compliance with our legal obligations, and/or your consent. We use Personal Information to:

Text Messaging

By opting to use the Services provided by Tether Health, you consent to receive SMS (text) messages from Tether Health, its affiliates, and its partners pertaining to your account, services you have requested, and your interaction with Tether Health's Services. These messages may include appointment reminders, updates on services, promotional offers, and information relevant to your account and services.

You acknowledge and agree that:

You are the owner of the mobile device you used in order to initiate the SMS Enrollment and that you are authorized to consent to receive and pay for messages at that number
SMS messages may be sent using automated technology
You do not have to consent to receive SMS messages as a condition of purchasing any goods or services
Standard message and data rates may apply to any SMS messages sent or received
The frequency of messages varies – you may receive messages periodically based on your interaction with Tether Health's Services
Tether Health shall not be liable for delayed or undelivered messages

Opt-Out Instructions

To opt out of SMS messages at any time, reply “STOP” to any message you receive. Upon receiving your request, we will send you a confirmation message and cease sending you SMS messages. For assistance or more information, reply “HELP”.

Disclosure of Your Personal Information

We do not sell, share, or otherwise disclose your Personal Information for reasons other than those described in this Privacy Policy.

We may disclose your Personal Information to a few third parties, including:

Third-party service providers, contractors, subcontractors, and business associates we use to support our business (e.g., cloud providers, legal providers)

Rights to Access, Correction, Deletion, and Data Portability

You have the right to: (1) confirm whether we are processing your Personal Information, (2) access that data, (3) correct inaccuracies, (4) delete your Personal Information, (5) receive your Personal Information in a portable format, and (6) appeal our decision regarding your rights request.

Right to Limitation (California Residents Only)

You have the right to request restrictions on the processing of your Personal Information. To exercise this right, please contact us at support@tetherhealth.com with the subject line "California Right to Limitation."

Right to Non-discrimination (California Residents Only)

We are committed to ensuring that you do not face discrimination for exercising any of your rights under the California Consumer Privacy Act (CCPA). We will not deny goods or services, charge different prices, or provide a different level of quality based on your exercise of these rights.

Response Timeline

We will respond to your request to exercise these rights within 45 days. In some cases, we may require up to an additional 45 days to respond, depending on the complexity and number of requests. You will be notified if we require more time.

How We Keep Your Personal Information Secure

We retain Personal Information as long as it is necessary and relevant for our operations. We also retain Personal Information from closed accounts to comply with applicable law, prevent fraud, resolve disputes, troubleshoot problems, assist with investigations, enforce our Terms of Service, and collect any fees owed.

We strive to use industry-standard data collection, storage, and processing practices and security measures to protect against any unauthorized access to, accidental loss of, or disclosure of your information. These safeguards may vary based on the sensitivity of the information that we collect and store.

Please note: No security method or combination of methods is foolproof. We cannot warrant or guarantee the absolute security of any Personal Information that may be transmitted to or from our Services. Any transmission of Personal Information is at your own risk.

Please note that we will never send you an email requesting confidential information, such as account numbers, usernames, passwords, or Social Security Numbers.

In the event of a data or security breach, we will take the following actions: promptly investigate the security incident, comply with applicable laws and regulations, cooperate with any affected user, document and record actions taken, and conduct a post-incident review. We will notify you of any data or security breaches as required by and in accordance with applicable law.

Data Retention

We may retain your Personal Information for as long as necessary for our business purposes, or as required to comply with our legal obligations, resolve disputes, and enforce our agreements. We reserve the right to retain and use your information as necessary to provide our Services and fulfill our business operations.

Similarly, Professionals may retain your Personal Information for periods they deem necessary for their operational purposes, to comply with their legal obligations, to resolve disputes, and to enforce their agreements.

Children Under The Age Of 18

This Website and Platform may be intended to facilitate and coordinate the care of individuals under the age of 18 (“Minors”) and their parents or guardians. In circumstances where Personal Information of a Minor is provided, such data will be collected, used, and processed in compliance with all applicable laws including the Children's Online Privacy Protection Act (COPPA), HIPAA, and other relevant healthcare privacy regulations.

If you are a parent or guardian and believe that your child's Personal Information has been collected without appropriate consent, please contact us immediately at support@tetherhealth.com.

The Children's Online Privacy Protection Act of 1998 and its rules (collectively, “COPPA”) require us to inform parents and legal guardians about our practices for collecting, using, and disclosing personal information from children under the age of 13 (“Children”). We only collect as much information about a child as is reasonably necessary for the child to participate in an activity, and we do not condition his or her participation on the disclosure of more Personal Information than is reasonably necessary.

At any time, you may review the child's personal information maintained by us, require us to correct or delete the personal information, and/or refuse to permit us from further collecting or using the child's information. You can review, change, or delete your child's personal information by logging into your child's account and visiting the account profile page or sending us an email at support@tetherhealth.com.

Opt-Out And Unsubscribe

We may send communications, including emails, to you using your Personal Information. You may opt out of receiving certain communications (e.g., newsletters, promotions) by emailing us your preference. However, even if you opt out, we may still send you communications necessary to provide ongoing services you request from us.

We will only send you offers, promotions and other marketing communications if you have expressly agreed to receive those types of messages. If you agree to receive these communications, but later change your mind and wish to opt-out of receiving offers, promotions, and other marketing communications, you may do so by emailing support@tetherhealth.com.

Jurisdiction And Cross-Border Transfer

We are located in the United States. The Service may only be used within certain states within the United States. Accordingly, this Privacy Policy, and our collection, use, and disclosure of your information, is governed by U.S. law.
